"I do have concerns" Roscioli told Gruver, pointing out that an evaluation showed he was at moderate risk to re-offend. "Mr. Gruver, your case gives me considerable pause," the judge said. Roscioli's punishment was the highest permitted in the standard range of the state's sentencing guidelines. Assistant District Attorney Patricia C. Broscius told the judge there were no legal reasons to exceed the standard range.

Gruver apologized "for any actions I have taken. I made a huge mistake and I regret it." A Northampton Community College student, Gruver said he wants to get on with his life.

Gruver in August 2005 took vodka in water bottles to a Bethlehem home where the 12-year-old girl, a 15-year-old girl and a 16-year-old boy were alone. Gruver allowed the 12-year-old to drink until she was stumbling, then threw her into a swimming pool. He took her out of the pool and carried her into the house, where he locked her and himself in a bedroom. The other children banged on the door, but Gruver ignored them. They found a ladder and placed it at a window, where they saw the girl lying on a bed, asleep and nude from the waist down.
