Responding to a lawsuit filed in 2004 by the owner of several adult clubs, a federal judge recently voided certain parts of the county's adult-entertainment code, calling them unconstitutional.
However, most of the provisions of the code remain intact and county officials are pleased that U.S. District Judge John Antoon II ordered no major changes.
"The criminal provisions challenged here regulate the very movements an erotic dancer can make during a performance," Antoon wrote in a 44-page decision. "Because the ordinances criminalize the protected expression conveyed through erotic dances, the ordinances chill the dancers' exercise of free expression."
Attorney Steve Mason said Antoon's order is a victory for the First Amendment. But adult-club owners may not be ready to relax their own rules regulating dancers' routines just yet.
Gerald Uranick, owner of several adult clubs, did not want to be interviewed Wednesday. But Mason, his attorney, said most owners probably will "continue with the internal policy of no touching of customers and simulating sex."
Mason and Uranick went to court after the Metropolitan Bureau of Investigation busted dozens of employees at Cleo's Gentlemen's Club on narcotics and adult-code violations during Operation Over Exposed in 2004.
