Brad Gale Brad R. Gale, 39, agreed to plead guilty to a charge of first-degree felony forcible sex abuse if prosecutors agreed to drop a charge of forcible sodomy.

However, he was required to serve only two weeks in jail, with the rest of his time on an ankle-monitoring system. West's case will be dismissed, however, because he died last weekend, said Utah County prosecutor Donna Kelly.

Gale was sentenced Monday to 200 days in jail and given credit for the 200 days he had already served and his 4th District Court case was closed.

Gale was convicted of four first-degree felonies, including sodomy on a child, for abusing the same 14-year-old boy. Gale's attorney Herb Gillespie said he worked with state prosecutors to get a recommended sentence of 10 years to life in prison for the sodomy conviction.

The other charges of aggravated sex abuse and forcible sodomy, normally convictions carrying sentences of five-years-to-life, would be served concurrently with the 10-years-to-life.

That sentencing hasn't taken place, however, as attorneys were waiting for Monday's hearing in Utah County. Gillespie is also waiting until Gale is designated to a federal prison.

Gale was accused of taking nude pictures of the 14-year-old boy then showing them to others and offering them the chance to have sex with the boy.

He was sentenced to 15 years in federal prison, which Gillespie is hoping can be served in Butner, N.C., where there are programs to help sex-offenders.
